ACHT UM AN gCEAD LEASÚ AR AN mBUNREACHT, 1939
ACHT CHUN LEASÚ DO DHÉANAMH AR AN mBUNREACHT. [2adh Meán Fhómhair, 1939.]
DE BHRÍ gur féidir, de bhuadh Airteagail 46 den Bhunreacht, foráil ar bith den Bhunreacht do leasú sa tslí foráltar leis an Airteagal san:
AGUS DE BHRÍ go bhforáltar le hAirteagal 51 den Bhunreacht do bhféadfaidh an tOireachtas, fé cheann trí bliana tar éis dáta an chéad Uachtarán do dhul i gcúram a oifige agus fé réir mar a foráltar ansan ina dhiaidh sin, leasú do dhéanamh ar aon cheann no cinn d'fhorálacha an Bhunreachta:
AGUS DE BHRÍ go ndeachaidh an chéad Uachtarán i gcúram a oifige an 25adh lá de Mheitheamh, 1938:
AGUS DE BHRÍ gur mar seo leanas atá fo-alt 3° d'alt 3 d'Airteagal 28 den Bhunreacht:—
3°. Ní cead aon ní dá bhfuil insan Bhunreacht so d'agairt chun aon dligheadh dá n-achtuigheann an tOireachtas do chur ó bhail má luaidhtear ann gur dligheadh é chun slándáil an phobail do chur i n-áirithe agus chun an Stát do chaomhna i n-aimsir chogaidh no ceannairce fá arm, ná chun aon ghníomh dá ndéantar no a bheireann le tuigsint gur gníomh é a déantar do bhun aon dlighidh den tsórt sin do chur ar neamh-ní.
AGUS DE BHRÍ go bhfuil beartuithe an Bunreacht do leasú tré sna focail seo leanas do chur isteach ann i ndeireadh fo-ailt 3° d'alt 3 d'Airteagal 28 agus ina gcuid den fho-alt san, sé sin le rá:—
Sa bhfo-alt so foluigheann ‘aimsir chogaidh’ tráth a bheidh coinbhliocht fá arm ar siúl ná beidh an Stát páirteach ann ach go mbeidh beartuighthe ag gach Tigh den Oireachtas ina thaobh le rún go bhfuil ann, de dheascaibh an choinbhliochta san fá arm, staid phráinne náisiúnta dhéanann deifir do bhonn beatha an Stáit.:
ACHTUIGHEADH AN tOIREACHTAS AR AN ÁBHAR SAN MAR LEANAS:—
1. An Leasú d'achtú
Ar an Acht so do rith tiocfaidh an leasú san atá beartuithe do dhéanamh ar an mBunreacht chun bheith, agus beidh, éifeachtach láithreach agus déanfar na focail seo leanas, sé sin le rá:—
Sa bhfo-alt so foluigheann ‘aimsir chogaidh’ tráth a bheidh coinbhliocht fá arm ar siúl ná beidh an Stát páirteach ann ach go mbeidh beartuighthe ag gach Tigh den Oireachtas ina thaobh le rún go bhfuil ann, de dheascaibh an choinbhliochta san fá arm, staid phráinne náisiúnta dhéanann deifir do bhonn beatha an Stáit.

2. Luadh
(1) An Chéad Leasú ar an mBunreacht do bhéarfar mar ainm ar an leasú deintear ar an mBunreacht leis an Acht so agus féadfar chun gach críche san do ghairm de.
(2) Féadfar an tAcht um an gCéad Leasú ar an mBunreacht, 1939, do ghairm den Acht so.

FIRST AMENDMENT OF THE CONSTITUTION ACT, 1939
AN ACT TO AMEND THE CONSTITUTION. [2nd September, 1939.]
WHEREAS by virtue of Article 46 of the Constitution any provision of the Constitution may be amended in the manner provided by that Article:
AND WHEREAS it is provided by Article 51 of the Constitution that any of the provisions of the Constitution may, subject as thereinafter provided, be amended by the Oireachtas within a period of three years after the date on which the first President shall have entered upon his office:
AND WHEREAS the first President entered upon his office on the 25th day of June, 1938:
AND WHEREAS sub-section 3° of section 3 of Article 28 of the Constitution is as follows:—
3°. Nothing in this Constitution shall be invoked to invalidate any law enacted by the Oireachtas which is expressed to be for the purpose of securing the public safety and the preservation of the State in time of war or armed rebellion, or to nullify any act done or purporting to be done in pursuance of any such law.
AND WHEREAS it is proposed that the Constitution be amended by inserting the following words at the end of and as part of sub-section 3° of section 3 of Article 28, that is to say:—
In this sub-section ‘time of war’ includes a time when there is taking place an armed conflict in which the State is not a participant but in respect of which each of the Houses of the Oireachtas shall have resolved that, arising out of such armed conflict, a national emergency exists affecting the vital interests of the State.:
BE IT THEREFORE ENACTED BY THE OIREACHTAS AS FOLLOWS:—
1. Enactment of the Amendment
Upon the passing of this Act the said proposed amendment of the Constitution shall forthwith become and be effective and the following words, that is to say:—
In this sub-section ‘time of war’ includes a time when there is taking place an armed conflict in which the State is not a participant but in respect of which each of the Houses of the Oireachtas shall have resolved that, arising out of such armed conflict, a national emergency exists affecting the vital interests of the State.
shall be inserted at the end of and as part of sub-section 3° of section 3 of Article 28 of the Constitution.
2. Citation
(1) The amendment of the Constitution effected by this Act shall be known as and may for all purposes be referred to as the First Amendment of the Constitution.
(2) This Act may be cited as the First Amendment of the Constitution Act, 1939.
