AN tACHT UM AN AONÚ LEASÚ IS FICHE AR AN mBUNREACHT, 2001
ACHT CHUN AN BUNREACHT A LEASÚ

DE BHRÍ gur cead, de bhua Airteagal 46 den Bhunreacht, foráil ar bith den Bhunreacht a leasú ar an modh a shocraítear leis an Airteagal sin:
AGUS DE BHRÍ go bhfuil beartaithe Airteagail 13, 15, 28 agus 40 den Bhunreacht a leasú:
ACHTAÍTEAR AG AN OIREACHTAS AR AN ÁBHAR SIN MAR A LEANAS:
1. Airteagail 13, 15, 28 agus 40 den Bhunreacht a leasú
(a) Na leasuithe ar Airteagail 13, 15, 28 agus 40 den Bhunreacht atá leagtha amach i gCuid 1 den Sceideal a ghabhann leis an Acht seo, déanfar iad sa téacs Gaeilge.
(b) Na leasuithe ar na hAirteagail sin atá leagtha amach i gCuid 2 den Sceideal a ghabhann leis an Acht seo, déanfar iad sa téacs Sacs-Bhéarla.
(c) Déanfar Airteagal 15.5 den dá théacs a uimhriú mar Airteagal 15.5.1° agus déanfar fo-ailt 6° agus 7° d'Airteagal 40.4 den dá théacs a uimhriú mar fho-ailt 5° agus 6° faoi seach.
2. Lua
(1) An tAonú Leasú is Fiche ar an mBunreacht a thabharfar ar an leasú a dhéantar ar an mBunreacht leis an Acht seo.
(2) Féadfar an tAcht um an Aonú Leasú is Fiche ar an mBunreacht, 2001, a ghairm den Acht seo.

Cuid 1
In Airteagal 13.6, “, taobh amuigh de chásanna breithe báis,” a scriosadh;
In Airteagal 15.5, an fo-alt seo a leanas a chur isteach:
2° Ní cead don Oireachtas aon dlí a achtú lena ndéanfar socrú chun pionós an bháis a ghearradh;
In Airteagal 28.3.3°, “seachas Airteagal 15.5.2°” a chur isteach i ndiaidh “sa Bhunreacht seo”;
In Airteagal 40.4, fo-alt 5° a scriosadh.

TWENTY-FIRST AMENDMENT OF THE CONSTITUTION ACT, 2001
AN ACT TO AMEND THE CONSTITUTION
[27th March, 2002]
WHEREAS by virtue of Article 46 of the Constitution any provision of the Constitution may be amended in the manner provided by that Article:
AND WHEREAS it is proposed to amend Articles 13, 15, 28 and 40 of the Constitution:
BE IT THEREFORE ENACTED BY THE OIREACHTAS AS FOLLOWS:
1. Amendment of Articles 13, 15, 28 and 40 of the Constitution
(a) The amendments to Articles 13, 15, 28 and 40 of the Constitution which are set out in Part 1 of the Schedule to this Act shall be made in the Irish text.
(b) The amendments to those Articles which are set out in Part 2 of the Schedule to this Act shall be made in the English text.
(c) Article 15.5 of both texts shall be numbered as Article 15.5.1° and subsections 6° and 7° of Article 40.4 of both texts shall be numbered as subsections 5° and 6° respectively.
2. Citation
(1) The amendment of the Constitution effected by this Act shall be called the Twenty-first Amendment of the Constitution.
(2) This Act may be cited as the Twenty-first Amendment of the Constitution Act, 2001.
SCHEDULE
Part 2
In Article 13.6, to delete “, except in capital cases,”;
In Article 15.5, to insert the following subsection:
2° The Oireachtas shall not enact any law providing for the imposition of the death penalty.;
In Article 28.3.3°, to insert “other than Article 15.5.2°” after “Constitution”;
In Article 40.4, to delete subsection 5°.
